DMCA & IP Complaint Policy

Scope: All Merch365 surfaces — the platform at merch365.ai, the storefronts at *.merch365.shop, the apex marketing site, and preview/concept stores. Incorporated into the Terms of Use and the Storefront Terms of Sale & Use.

Merch365 respects intellectual-property rights and stores material at the direction of its users. This Policy explains how to report (1) copyright infringement under the DMCA and (2) trademark / false-affiliation concerns — including objections to a preview/concept store — and how Merch365 responds.

1. Copyright complaints (DMCA notice-and-takedown)

1.1 Designated agent. Send copyright-infringement notices to Merch365’s designated agent:

1.2 What a valid notice must include (per 17 U.S.C. § 512(c)(3)): (a) a physical or electronic signature of the rights owner or authorized agent; (b) identification of the copyrighted work claimed to be infringed; (c) identification of the allegedly infringing material and enough information to locate it (e.g., the store URL or product page); (d) your contact information; (e) a statement that you have a good-faith belief the use is not authorized by the owner, its agent, or the law; and (f) a statement, under penalty of perjury, that the information is accurate and that you are the owner or authorized to act on the owner’s behalf.

1.3 Our response. On receiving a valid notice, Merch365 will expeditiously remove or disable access to the identified material and take reasonable steps to notify the affected user.

1.4 Counter-notification. A user whose material was removed may submit a counter-notice under 17 U.S.C. § 512(g) including: the user’s signature; identification of the removed material and its prior location; a statement under penalty of perjury that the user has a good-faith belief the material was removed by mistake or misidentification; the user’s contact information; and consent to the jurisdiction of the appropriate federal court. If we receive a valid counter-notice, we may restore the material in 10–14 business days unless the complainant files a court action seeking to restrain the user.

1.5 Repeat infringers. Merch365 will, in appropriate circumstances, suspend or terminate the accounts of users who are repeat infringers.

2. Trademark & false-affiliation complaints

Because Merch365’s model involves brand logos, marks, and preview stores branded for prospects, we maintain a dedicated path for trademark and false-affiliation concerns (including “this store implies my brand authorized it” objections).

2.1 How to complain. Email legal@merch365.ai (subject: “Trademark / Brand Objection”) with: your name and role; the brand/mark at issue and your rights in it; the store URL(s) or material at issue; and the nature of your concern (e.g., unauthorized use of your mark, or an implication of affiliation, sponsorship, or endorsement that does not exist).

2.2 Preview/concept-store objections — expedited. If your complaint concerns a private preview/concept store, we will treat it as priority. Our goal is to quarantine the objected-to preview store the same business day and remove it within one business day, and to suppress further outreach for that brand. Preview stores are non-indexed, unlisted, and have checkout disabled (see the Terms of Use §5); this objection path is an additional safeguard.

2.3 Our response. We review trademark/false-affiliation complaints promptly and may remove, quarantine, rename, or modify the material or store, decline future outreach to the brand, and/or contact the relevant user. We may ask for additional information to evaluate the claim.

3. Misuse of this process

Knowingly making a material misrepresentation in a copyright notice or counter-notice may result in liability under 17 U.S.C. § 512(f). Please complain in good faith.
